Investors planning an EB-5 filing have a hard deadline this month. A final Department of Homeland Security rule published in the Federal Register on September 30 takes effect November 30, and every EB-5 petition postmarked on or after that date must carry the new, much higher fees.

The initial Form I-526E petition for regional-center investors more than doubles, from $3,675 to $7,850, and with the Integrity Fund fee rising to $1,100 the government total at that first filing becomes $8,950. Standalone investors filing Form I-526 will pay $7,615, and Form I-829, filed later to remove conditions, rises from $3,750 to $5,000. The minimum investment amounts themselves do not change under this rule.

Why it matters: South Florida Malayalees (SFM) readers weighing an EB-5 investment, or helping family members do so, can save several thousand dollars in filing fees alone by having a complete petition postmarked by November 29 — but rushing an incomplete filing carries its own risks. This is general information, not legal or investment advice; review timing with an immigration attorney before filing.
